1. Introduction

This website found under the cannabotanicaldaily.com URL is operated by VLV HOLDINGS LIMITED. The references to “we” and “us” and “our” shall be deemed to be references to the said company.

References to “you” and “your” are deemed to be references to a person placing an order via this website.

2. Scope

These terms and conditions are a legal agreement between us and apply to the sale of retail goods to consumers. You must read and accept all the terms and conditions contained in this agreement and our privacy policy prior to buying goods from us. The language of the agreement is English.

3. Order acceptance

All orders placed by you are subject to our acceptance. We reserve the right at all times and in our sole discretion to refuse to accept an order for any reason and without liability to you.

Orders may only be placed by individual customers and corporations purchasing goods other than for resale. Wholesale customers should contact us direct at the above address before placing an order.

After you have placed the order with us and paid for the goods, we will send you an order confirmation by email with your order number and details of the product you have ordered. Importantly we will tell you from where you are buying the goods if not the UK (see paragraph 10 below). The acceptance of your order and a contract of sale between us will not take place until the goods have been paid for in full in cleared funds.

4. Order placement

It is vitally important that you check carefully the quantity of goods that you order from us. We will deliver what you order. Whilst you have a right of cancellation you must pay for the delivery costs back to us.

5. Access to the agreement

Once you have submitted an order you will be able to access your order by calling customer services. We will keep your order records for 12 months following delivery.

6. Descriptions and Product Information

We have made every effort to represent the size colours and general pictorial image of our products as accurately as possible. However, due to differences in monitors we are unable to guarantee what you see on will reflect the true product. If you have any questions about the product you may of course contact us.

VLV Holdings Limited warrants that the goods that you buy will at the time of delivery to you correspond to the description given. Except where you buy as a consumer (as defined in Section 12 Unfair Contract Terms Act 1977) all other warranties, conditions and terms relating to fitness for purpose, merchantability or condition of the goods, whether implied by statute or common law or otherwise are excluded. No statement, description, information, warranty, condition or recommendation contained in any catalogue list or similar shall be construed to enlarge, vary or override in any way the terms of this clause.

7. Prices

All prices on the website are quoted in pounds sterling (£). They include delivery charges unless we state otherwise.

In respect of goods having a consignment value not exceeding £15 (not exceeding €22 in the case of goods for delivery not to UK) no VAT arises. For goods having a higher consignment value the price we quote includes VAT, if applicable.

Please note that on all orders placed for delivery outside the EU it is the customer’s responsibility to pay any import duties that may be applicable for deliveries in or to that particular country. Please also refer to paragraph 10 below.

We may change the prices for online and offline orders at any time and without any notice. Should we make an offer we will indicate the date on which the offer lapses. This is the date by which we must receive cleared funds.

We try to ensure that all prices given on the site are correct. However, mistakes can occur. If we have quoted an incorrect price on the site and if the correct price is lower than that quoted, we will automatically assume that you wish to continue with your order. However if the correct price is higher than that originally quoted, we will contact you to ask if you still want to order the goods.

8. Payment terms

You confirm that the credit card/debit card that is being used is yours. All credit /debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery. Furthermore, we are not obliged to inform you of the reason for the refusal. You should note that your bank or card issuer may charge you as a result of our processing your credit /debit card payment in accordance with your order. VLV Holdings Limited has no responsibility for such charges.

9. Delivery

Where there is a delay in the supply of goods, we will advise you as soon as possible. If the goods cannot be delivered within 30 days of your order, we will notify you of this delay and you may either cancel your order or agree a further delivery time with us. Orders are delivered from stock. We aim to ship all orders placed by 2.00 p.m (Monday to Friday) the next working day. Otherwise we aim to ship on the following working day. Typically delivery will be within 5-7 working days.

If you have ordered multiple products or ordered a multi pack product each separate item or series of items up to a consignment value of £15 (not exceeding €22 ) constitutes a separate contract between us and will be shipped accordingly. We may also despatch your order in a number of consignments, due to size of package or stock being at different locations. We will always endeavour to keep you informed of the progress of your order by email and where your goods are coming from.

If you do not receive your consignment within 7 working days of receiving the Confirmation email, Contact Us and we will investigate. If the manufacturer offers any form of guarantee with a product details will be included in the packaging delivered to you.

Delivery Charges:

Delivery charges are included within the total item price and delivery as advertised, and due to the different services chosen and packaging required will depend on your total Delivery, Title and Risk. (eg. Item price £15.00 + £7.99 shipping & Handling – Total shown on statement £22.99)

Orders will be sent to the delivery address that you have submitted with your order. We cannot be held responsible if that delivery address is incorrect.

Please note that we cannot deliver to PO boxes.

There are some delivery restrictions on where we can deliver and these will be given to you on request.

Risk and Title of the products will be transferred to you as soon as they are dispatched to the delivery address given by you.

Once a product has been despatched, all risk of damage to or loss of the items bought by you will pass to you.

EU Delivery Charges

Orders up to £15 – £7.99
Orders up to £25 – £10.99
Orders over £25 – £18.99

For orders outside the EU, please contact us for a quotation.

10. Customs and VAT

If the goods are despatched from stock outside EU you or the person you have asked us to deliver the goods to will be the importer of record of the goods. The importer will be liable for any customs duties, VAT or other taxes and any associated costs. VLV Holdings Limited recommend you check with your local customs officials or post office for information regarding any import restrictions and duties and taxes that may apply.

Note that imports are subject to opening, inspection and other controls by customs authorities and we have no control over this.

12. Events beyond Our control

VLV Holdings Limited reserve the right to suspend, delay or cancel an order or delivery without being liable for any loss or damage. That is if supply of the goods is prevented or delayed by circumstances beyond our control including but not limited to; adverse weather conditions, including fire or flood; civil strife, riots or war; labour disputes; accidents; or any other cause or circumstances beyond our reasonable control.

13. Marketing and Promotions

We have several promotional discount codes, and ‘new customer’ discount codes running simultaneously. Only one discount code can be used per customer.

Agents’ credits. It is the responsibility of all agents to declare their earnings to the appropriate tax authorities. VLV Holdings Limited will not be liable to pay tax for any of its agents.

14. Indemnity

You agree to indemnify and hold us, our subsidiaries, and affiliates, and our respective officers, agents, partners and employees, harmless from any loss, liability, demand, claim or legal proceedings brought or threatened, including expenses of any character suffered or incurred arising out of your use of the Site in violation of these terms and conditions and/or arising from your use of or conduct on the Site and/or a breach of these terms and conditions.

You have the right to obtain from us a copy of your personal data, this shall be supplied within 14 working days of request.
